FSBO Marketing Terms of Use
Effective September 30, 2026
These Terms of Use govern your use of FSBO Marketing, including our website, seller dashboard, property pages, marketing tools, assisted features, QR tools, and related services. By creating an account or using the service, you agree to these terms.
1. What FSBO Marketing is
FSBO Marketing provides software and marketing tools for homeowners who want to market a property themselves. FSBO Marketing is an independent marketing service. It is not a real estate brokerage, real estate agent, attorney, title company, lender, appraiser, inspector, tax adviser, or financial adviser.
We do not represent you or a buyer in a real estate transaction, negotiate on your behalf, determine whether a transaction is legally appropriate, or guarantee that a property will sell.
2. Your account
You are responsible for providing accurate account information, protecting your password and sign-in credentials, and promptly notifying us if you believe your account has been used without permission. You are responsible for activity performed through your account unless applicable law provides otherwise.
3. Property listings and seller responsibility
You control the facts that are published about your property. You are responsible for confirming that your address, price, square footage, room counts, features, condition, garage information, photos, descriptions, showing information, links, floor plans, and other listing content are accurate and lawful.
Public records, automated property data, image analysis, and other third-party information are provided as starting points only. They may be incomplete, delayed, or incorrect. You should verify material facts before publishing or relying on them.
4. Fair housing and lawful marketing
You may not use FSBO Marketing to publish discriminatory, deceptive, fraudulent, unlawful, or misleading housing content. You are responsible for complying with applicable fair housing, advertising, disclosure, property, zoning, licensing, and transaction laws that apply to you and your property.
5. Photos, floor plans, videos, and links
You may upload only content you own or have permission to use. By uploading content, you give FSBO Marketing a limited license to store, process, resize, display, and distribute that content as needed to provide the service and create the marketing materials you request.
If you upload a floor plan or other third-party material, you are responsible for the right to use and publish it. A floor plan may be approximate and may not reflect later renovations or changes.
6. AI-assisted features
Seller Assistant features may use artificial intelligence to help organize photos, suggest visible property features, draft listing language, or answer questions from information associated with a property. AI output can be incomplete or wrong and should not be treated as an appraisal, inspection, legal opinion, or verified property fact.
AI-suggested property features are kept separate from seller-confirmed facts unless you choose to confirm or use them. You remain responsible for reviewing any AI-generated or AI-assisted content before it becomes part of your listing.
7. Property data and valuation tools
When property-data integrations are enabled, FSBO Marketing may retrieve information from third-party providers. Provider data is not guaranteed to be complete or accurate. Automated valuation or comparable-sales information, if offered, is informational only and is not an appraisal or a promise of market value.
8. Free and paid plans
FSBO Marketing currently offers a free property plan and optional paid property upgrades. Paid consumer plans are purchased for an individual property and are currently one-time charges rather than recurring consumer subscriptions, unless a checkout page clearly states otherwise before purchase.
Plan features, limits, and prices are displayed before purchase and may change for future purchases. An administrator may grant or adjust plan access without creating a payment record, for example for support or testing purposes.
9. Payments
Card payments are processed by Stripe. FSBO Marketing does not store your full payment-card number in its application database. We may retain payment status, amount, plan, Stripe payment reference, and related transaction metadata needed for support, accounting, fraud prevention, and plan access.
Any refund rights are governed by applicable law and any refund terms shown at purchase or otherwise provided by FSBO Marketing.
10. Buyer inquiries and communications
Public property pages may allow prospective buyers to contact the seller. FSBO Marketing transmits and stores those inquiries so the seller can review them. We do not verify the identity, intent, financing, or legitimacy of every person who sends a message. Sellers and buyers should use appropriate judgment and security practices when communicating or arranging a showing.
11. QR codes, analytics, and marketing activity
FSBO Marketing may record property-page views, QR scans, inquiries, and related marketing activity. These measurements are intended to help sellers understand activity around their listing. They may not represent unique people and should not be treated as a guarantee of buyer interest.
The public website may also use Google Analytics when enabled to understand aggregate site traffic and feature usage. Analytics data is informational and may be affected by browser settings, consent choices, blocking tools, or measurement limitations.
12. Third-party services
The service may rely on providers such as Stripe for payments, OpenAI for optional assisted features, property-data providers such as RentCast when enabled, SendGrid for email delivery, and embedded services such as YouTube or maps. Those services may have their own terms and privacy practices.
13. Availability and changes
We may update, improve, suspend, or discontinue features when needed for security, reliability, legal compliance, provider changes, or product development. We do not guarantee uninterrupted access to every feature or third-party integration.
14. No guarantee of sale or outcome
FSBO Marketing does not guarantee a sale, sale price, number of inquiries, marketing reach, valuation, legal outcome, or transaction result. Real estate decisions remain the responsibility of the seller and buyer.
15. Disclaimer of warranties
To the extent permitted by law, the service is provided on an “as is” and “as available” basis. We do not make warranties about the accuracy of third-party data, AI output, buyer messages, market information, or uninterrupted service.
16. Limitation of liability
To the extent permitted by law, FSBO Marketing will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, third-party information, a real estate transaction, or content submitted by users. Nothing in these terms excludes liability that cannot legally be excluded.
17. Suspension or termination
We may suspend access where reasonably necessary to address fraud, abuse, security threats, unlawful conduct, nonpayment, or material violations of these terms. You may stop using the service at any time.
18. Changes to these terms
We may update these terms as the service changes. The effective date above identifies the current version. Material changes may be communicated through the service or by other reasonable means.
